Terms of Agreement

These Terms of Agreement ("Terms") govern your access to and use of the Camp Days website located at www.campdays.com and any related subdomains, products, or services (collectively, the "Services"). These Terms are entered into between you and Camp Days, LLC ("Camp Days," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Intended Users

Camp Days is intended for use by parents, legal guardians, and caregivers who are at least 18 years old. The Services are not directed to children under the age of 13, and children may not create accounts or use the Services directly.

2. Description of Services

Camp Days provides tools and resources to help parents and caregivers discover, plan, and book camps and enrichment programs for children. For camps that offer booking through the Services, Camp Days facilitates the booking transaction and processes payment on behalf of the camp using a third-party payment processor. Camp Days does not operate, manage, supervise, or control the camps, programs, or providers listed on the Services.

3. Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. User Responsibilities

By using the Services, you agree that you will:

• Use the Services only for lawful purposes;

• Provide information about children only if you are their parent or legal guardian, or have authority to do so;

• Not misuse, interfere with, or attempt to gain unauthorized access to the Services;

• Not submit false, misleading, or infringing content.

5. Children’s Information

Parents and guardians may voluntarily provide limited information about their children for camp-planning purposes. You represent and warrant that you have the legal authority to provide such information and consent to its processing in accordance with our Privacy Policy.

6. Third-Party Camps and Services

Camps, programs, and providers listed on Camp Days are third parties. Camp Days does not endorse, verify, or guarantee the quality, safety, legality, or availability of any camp or service.

You acknowledge that:

• Any agreements or transactions with camps are solely between you and the camp provider;

• Camp Days is not responsible for camp operations, supervision, pricing, cancellations, injuries, or disputes.

When you book a camp or program directly through the Services, Camp Days facilitates that transaction, including collecting payment and applying the cancellation and refund policy described in Section 8 below. Camp Days is not a party to the underlying agreement between you and the camp regarding the program itself, and remains not responsible for the camp's operations, supervision, staffing, safety, or the quality of the program.

7. SMS Messaging terms

By providing your mobile phone number and opting in, you consent to receive SMS or MMS messages from Camp Days, including but not limited to account notifications, camp registration alerts, reminders, updates, and promotional messages.

Message frequency may vary. Message and data rates may apply depending on your mobile carrier and plan.

You can opt out of receiving text messages at any time by replying STOP to any message. After opting out, you may receive a confirmation message, and no further messages will be sent unless you opt in again.

Participation in SMS messaging is not required to use Camp Days. Your consent to receive text messages is not a condition of purchase.

8. Payments and Billing

Booking Payments. When you book a camp session through the Services, you authorize Camp Days to charge your selected payment method for the full session price at the time of booking. Payments are processed through Stripe, a third-party, PCI-compliant payment processor. Camp Days does not store your full payment card details.

Camp Fees. Camps that accept bookings through the Services pay Camp Days a transaction fee, calculated as a percentage of each booking. This fee is deducted from the amount paid to the camp and does not change the price displayed to you at checkout.

Cancellations and Refunds. The following cancellation and refund policy applies to all camp session bookings made through the Services: (a) if you cancel 30 or more days before the session start date, you will receive a full refund; (b) if you cancel within 30 days of the session start date, no refund will be issued; (c) if the camp cancels the session for any reason, you will receive a full refund regardless of timing. Refund requests must be submitted through your Camp Days account.

Payout to Camps. Funds collected from bookings are held by Camp Days and released to the camp's connected payment account after the applicable session begins.

Taxes. You are responsible for any applicable taxes associated with your booking.

9. Intellectual Property

All content on the Services, including text, graphics, logos, and software, is owned by or licensed to Camp Days and is protected by intellectual property laws. You may not copy, modify, distribute, or exploit any content without our prior written consent.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the Services at any time.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CAMP DAYS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMP DAYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

13. Indemnification

You agree to indemnify and hold harmless Camp Days and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Georgia.

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE THE RIGHT TO A TRIAL BY JURY.

15. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted with a revised Effective Date. Continued use of the Services constitutes acceptance of the revised Terms.
